WE HAVE A BIG BOND ISSUE COMING THROUGH.

APRIL 24TH IS GOING TO BE THE FIRST DAY OF EARLY VOTING THAT WILL LAST TO MAY 2ND.

AND OFFICIAL VOTING DAY IS MAY 6TH.

WE WE WANT EVERYONE TO BE A VOTER, GO OUT TO VOTE.

IT'S YOUR CONSTITUTIONAL RIGHT.

AND THEN JUST A REMINDER THAT WE HAVE FOUR MONTHS REMAINING IN THE OPERATIONAL YEAR.

SO FOR FY 22 AND FY 23, YOU'LL SEE THE YEAR OVER YEAR CHANGE THERE ON PAGE 23 AS OF FEBRUARY.

WHEN YOU SAY HISTORY, IS THIS FLUCTUATION ON 100% EMPLOYMENT OR WHAT HAS HAPPENED OVER HISTORY? SO THIS IT IS SO THE BUDGETED FIGURES ARE BASED WE DO BUDGET ON 100% EMPLOYMENT AND THEN WHEN THE ACTUALS COME IN, THEY TAKE INTO ACCOUNT THE VACANCIES.

SO AS OF FEBRUARY AND THIS GOES ALONG WITH THE FINANCIALS IN THE PRECEDING PAGES TO KIND OF SHOW YOU THAT FOR FEBRUARY 2023, WE ARE HAVE EXPENDED MORE PAYROLL AT THE SAME TIME THAN WE DID LAST YEAR.

AND THAT'S EXPECTED RIGHT NOW BECAUSE WE DID IMPLEMENT RAISES FOR THIS YEAR.

SO BASICALLY, WE ARE AT A VERY SIMILAR VACANCY RATE AS WE WERE THE PRIOR YEAR.

AND THEN YOU CAN SEE THE NON PAYROLL IS A LITTLE BIT SLIGHTLY HIGHER EXPENDED.

ONE THING WE DO GATHER FROM THAT IS WE HAVE HEARD SOME STILL SOME SUPPLY CHAIN ISSUES, BUT NOT AT THE EXTENT THAT WE HAD LAST YEAR.

SO THAT PROBABLY ACCOUNTS FOR SOME OF THAT BEING ABLE TO EXPEND SOME OF THE FUNDS.

IF YOU LOOK AT PAGE 24, IT'S A SIMILAR COMPARISON YEAR OVER YEAR, BUT JUST KIND OF A WAY TO LOOK AT IT A LITTLE BIT DIFFERENTLY.

SO YOU SEE OUR REVENUES THERE THAT ARE BUDGETED FOR BOTH YEARS AND THEN THE ADOPTED EXPENDITURE BUDGET AND THEN EXPENDITURES THROUGH FEBRUARY.

SO THAT'S WHERE WE'RE SEEING THAT ADDITIONAL EXPENDITURE.

SO A LOT OF THAT IS THE PAYROLL AND SOME OF THAT IS THE NON PAYROLL.

AND THEN YOU CAN SEE OUR OTHER USES AT 18 MILLION THAT WE'RE AT NOW FOR TRANSFERS OUT AND THEN EXPENSES AND OTHER USES THROUGH FEBRUARY.

SO THAT PLUS 33 MILLION IS WITH THE TRANSFER OUTS AND THE ADDITIONAL EXPENDITURES.

AND SO THE POINT OF THIS IS TO KIND OF SHOW THAT LAST YEAR WE DID HAVE A $14 MILLION ADD TO FUND BALANCE.

BUT JUST VISUALLY SPEAKING, WE'RE NOT GOING TO BE THERE THIS YEAR JUST AT THE LEVEL THAT WE HAVE OVER EXPENDED.

NOT NOT OVER EXPENDED, BUT THE LEVELS WE'VE EXPENDED MORE THAN LAST YEAR TO THIS POINT.

AND SO YOU CAN BRING US TO PAGE 25 AND THEN THIS IS OUR GENERAL FUND BALANCE PROJECTION.

THIS IS A SIMILAR FORMAT AS YOU SAW LAST MONTH, AND WE'LL CONTINUE TO UPDATE THIS AS WE GO THROUGH THE YEAR AND GAIN MORE KNOWLEDGE.

YOU CAN SEE AT THAT COLUMN, THE 23 COLUMN, THE SURPLUS DEFICIT WITH TRANSFERS OUT BASED ON THE INFORMATION THAT WE HAVE NOW.

IF WE CONTINUE THE SAME VACANCIES THAT WE'VE HAD THROUGHOUT THE YEAR AND WE KIND OF MIRROR SIMILAR TO WHAT WE DID LAST YEAR AS REGARDS TO PAYROLL PERCENTAGES, WE EXPECT TO BE IN DEFICIT AROUND $27 MILLION, BUT WE'RE STILL KIND OF WANTING TO PRESENT YOU THAT RANGE THAT YOU SEE AT THE VERY BOTTOM OF KIND OF THE WORST CASE SCENARIO OF A -33 AND THEN A BEST CASE SCENARIO TO A -18.

SO WE'RE STILL KIND OF LIVING IN THAT REALM.

BUT WE WANTED TO GIVE YOU A LITTLE MORE INFORMATION SINCE WE'RE SO FAR THROUGH THE YEAR.

FIRST OFF, JUST WANT TO INTRODUCE SHOW WHO THE TEAM IS THAT'S DOING YOUR DELINQUENT TAX COLLECTION.

WE HAVE AN OFFICE HERE IN GARLAND, JUST LITERALLY A FEW BLOCKS AWAY AT SHILOH AND MILLER IN THE TEXAS BRAND BANK BUILDING.

WE HAVE SIX ATTORNEYS IN THAT OFFICE AND TEN STAFF MEMBERS.

AND WE'RE HERE FOCUSING ON GARLAND ISD AND MAKING SURE OUR COLLECTIONS ARE TOP NOTCH.

WE DO HAVE 14 OFFICES ACROSS THE STATE, AND THIS IS ACTUALLY OUTDATED NOW.

WE NOW HAVE 66 ATTORNEYS, BUT WE'RE STILL OVER 400 STAFF MEMBERS.

ALL RIGHT, JUST FOR A BRIEF OVERVIEW ON WHAT WE DO AND WHERE WE COME INTO THE TAX COLLECTION PICTURE, THERE'S DIFFERENT PHASES OF YOUR TAX CYCLE.

IT STARTS WITH THE APPRAISAL PHASE.

JANUARY 1ST IS THE KEY FOR THE APPRAISAL DISTRICT BECAUSE THAT'S THE DATE AT WHICH THEY ASSESS PROPERTIES.

AND SO THEY DO THE APPRAISAL PHASE, JANUARY TO APRIL, THE APPRAISAL DISTRICT SENDS OUT YOUR TAX NOTICES IN APRIL.

THEN WE GET THE EQUALIZATION PHASE WHERE PEOPLE THEN CAN PROTEST THE AMOUNT OF THEIR TAXES, GO TO THE ASSESSMENT PHASE WHERE THE TAX OFFICE SENDS OUT THE BILLS AND THEN COLLECTION PHASE WHERE THEY'VE GOT THE NOTICES OUT.

THEY'RE NOT DELINQUENT.

TAX PAYERS HAVE UNTIL FEBRUARY 1ST TO PAY OR JANUARY 31ST TO PAY IT AND THEN ON ON OR ABOUT APRIL 1ST, BUSINESS PERSONAL PROPERTY TAXES GET TURNED OVER TO OUR OFFICE.

AND THEN ON JULY 1ST, THE REAL PROPERTY GET TURNED OVER TO US.

SO OUR TAX COLLECTION CYCLE THEN GOES FROM JULY 1ST TO JUNE 30TH.

SO MAINLY WHAT WE'LL BE TALKING ABOUT TODAY IS THE 2020 TAX YEAR BECAUSE WE COMPLETED THAT TAX CYCLE ON JUNE 30TH OF LAST YEAR.

WE'LL ALSO GIVE A BRIEF UPDATE ON WHAT WE'RE DOING FOR THE 2021 TAX CYCLE.

ALL RIGHT, SO WHAT HAVE WE DONE? PRE LITIGATION ACTIVITY.

WE TRIED TO DO MOST OF OUR COLLECTIONS WITHOUT RESORTING TO LITIGATION.

WE PREFER NOT TO HAVE TO SUE PEOPLE.

WE DON'T WANT TO FORECLOSE ON ANYONE'S HOMES.

AND SO ONE OF THE KEYS FOR US IS COMMUNICATIONS WITH YOUR TAX PAYERS IN 2022, WE DID 4100, MORE THAN 4100 PHONE CALLS TO TAXPAYERS.

WE MAILED OUT MORE THAN 8100 LETTERS.

AND AGAIN, COMMUNICATIONS IS KEY.

SO WE'VE GOT TO MAKE SURE THAT WE GET TO THOSE PEOPLE.

SO WE UPDATED OVER 1700 ADDRESSES AND PHONE NUMBERS DURING THE COURSE OF THOSE SEARCHES.

WE ALSO WENT OUT AND VISITED YOUR BUSINESSES.

WE PERFORMED 110 FIELD INSPECTIONS AND WENT OUT AND TALKED TO THE BUSINESS OWNERS TO MAKE SURE THEY UNDERSTAND WHAT THEIR RIGHTS AND RESPONSIBILITIES ARE AS BUSINESS OWNERS AND

WHAT THEY NEED TO DO TO GET THEIR TAXES PAID.

THEN AGAIN, SOMETIMES COMMUNICATION DOESN'T ALWAYS WORK, SO WE HAVE TO RESORT TO LITIGATION.

IN 2022, WE FILED 276 LAWSUITS ON BEHALF OF GARLAND ISD, WHICH LED TO 51 PROPERTIES THAT WERE POSTED FOR SALE.

AND OF THOSE POSTINGS, WE ONLY HAD TO SELL 12 OF THEM, 33 PAID PRIOR TO SALE, AND THEN SIX WERE CANCELED FOR VARIOUS REASONS PAYMENT AGREEMENTS, BANKRUPTCY, THOSE KINDS OF THINGS THAT WOULD STOP US.

WE ALSO FILED REPRESENTATION FOR THE SCHOOL DISTRICT IN 40 CASES IN FEDERAL COURT DUE TO BANKRUPTCY.

ALL RIGHT. SO YOU'VE HEARD WHEN WE DO IT, YOU'VE HEARD WHAT WE DO.

BUT THE MAIN THING WE DO IS HOW WE DO FOR YOU.

WHAT ARE OUR RESULTS? THE TAX OFFICE, THIS IS A SNAPSHOT OF YOUR TAX ROLL BEFORE IT GETS TURNED OVER TO US.

OF THE 282 PLUS MILLION DOLLARS FOR THE 2020 TAX YEAR, A LITTLE OVER 1.39% WAS TURNED OVER TO US FOR COLLECTIONS.

SO YOUR TAX OFFICE IS DOING A GREAT JOB.

THEY'RE COLLECTING A VERY, VERY HIGH RATE.

SO WE HAD 3.9 MILLION TO COLLECT.

AND OF THAT, WITHIN THAT TIME FRAME, THE JULY 1ST TO JUNE 30TH, WE COLLECTED JUST UNDER 2.9 MILLION OR 73.71%.

AND FOR THE ENTIRE TAX ROLL ON JULY 1ST OF 2021 WAS ABOUT 7.8 MILLION AND WE COLLECTED JUST UNDER 51%.

AND SO YOU CAN COMPARE THAT TO EVERYTHING ELSE.

THAT 51% COLLECTION RATE IS THE HIGHEST FOR ANY SCHOOL DISTRICT IN DALLAS COUNTY.

SO WE'RE DOING A REALLY GOOD JOB AND WE'RE PROUD OF THE WORK THAT WE'VE DONE.

OKAY. FOR THE 2021 TAX CYCLE THAT WERE THE TAXES THAT WERE TURNED OVER TO US ON JULY 1ST OF LAST YEAR, YOUR BASE LEVY, AGAIN, JUST UNDER $300 MILLION TAX OFFICE DID AN EVEN BETTER JOB AND ONLY TURNED OVER 1.28% TO US FOR COLLECTION.

AND SO FAR WE'VE COLLECTED AND THIS ACTUALLY MEMBERS THROUGH JANUARY 31ST, AND WE'VE PROVIDED THIS REPORT AND AS OF JANUARY 31ST, HAD COLLECTED JUST OVER 55% OF THE ROLE.

SO WE'RE WELL ON OUR WAY TO MAKING OUR GOALS, WHICH IS 70% OF TURNOVER YEAR AND 45% FOR ALL YEAR COLLECTIONS.

THIS IS JUST A SNAPSHOT OF WHAT YOUR ROLE LOOKS LIKE AS OF JANUARY 27TH.

YOU KNOW, THE BIGGEST PIECE OF THE PIE IS THE OVERSEAS I'VE AND DISABLED TAXPAYERS.

BY LAW, WE CAN'T FILE SUIT AGAINST THEM.

WE CAN'T DO ANYTHING.

WE BASICALLY DO NO COLLECTION ACTIVITIES AGAINST THEM BECAUSE THEY THEY HAVE THEIR TAXES DEFERRED.

AND SO THAT'S A LARGE PORTION OF YOUR ROLE.

WE ALSO HAVE A GOOD PORTION OF IT STRUCK OFF LITIGATIONS A LOT OF IT.

AND THEN PRE LITIGATION, WHICH IS THE ACCOUNTS WE HAVEN'T GOTTEN TO YET.

AND THAT'S ACTUALLY A VERY SMALL PERCENTAGE OF THE OVERALL ROLE.

ONE THING WE DO FOCUS ON THE TURNOVER YEAR, WHICH IS WHERE YOUR LARGEST AMOUNT OF DOLLARS ARE.

IT'S ALSO WHERE WE'RE GOING TO MAKE THE MOST IMPACT FOR YOUR COFFERS.

BUT WE DO FOCUS ON ALL YEARS, AS YOU SHOWED, FROM THE 51% COLLECTION RATE.

SO WE COLLECT MORE.

SO AFTER ONE YEAR, 74%, AFTER TWO YEARS, 85%.

AND THEN YOU CAN SEE FROM THE NEXT SEVERAL SLIDES WHERE FOR EACH OF THESE TAX YEARS, WE CONTINUE TO WORK IT AND GET IT DOWN AS SMALL AND AS SMALL AS SMALL AS WE CAN TO WHERE FINALLY WE GET TO LIKE THE 2016 TAX YEAR.

WE'VE BEEN COLLECTING ON THAT FOR FIVE YEARS NOW.

AND SO IF YOUR ORIGINAL 225 MILLION TAX ROLL, THERE'S ONLY 147,000 THAT WAS REMAINING DUE AND OF THAT AMOUNT, OVER 100,000 OF IT IS IN DISABILITY OR OVER 65 DEFERRALS.

SO WE CAN'T TAKE ANY COLLECTION ACTIVITY ON IT.

THE PRE LITIGATION ACTIVITY, YOU'LL NOTICE, IS NOW DOWN TO JUST OVER $1,700 AND THAT $1,700 IS IN 82 DIFFERENT ACCOUNTS.

SO THERE'S NOT A LOT WE CAN DO ON THOSE SHORT OF SENDING LETTERS AND MAKING A PHONE CALL OR TWO.

MOST OF THOSE ARE ESSENTIALLY WORTHLESS PIECES OF LAND.

THE PART THAT'S STILL IN LITIGATION ARE ONES WHERE WE'VE GOT JUDGMENTS ON IT AND WE CAN'T SELL THE PROPERTY AND THE CITY AND OR THE SCHOOL DISTRICT WANT TO OWN IT.

SO IT'S JUST GOING TO SIT OUT THERE UNTIL WELL, PROBABLY UNTIL IT GETS WRITTEN OFF, WHICH WE'RE GOING TO TALK ABOUT THAT LATER.

AND ONCE AGAIN, OUR FIRM, YOU KNOW, WE'RE RIGHT HERE IN GARLAND.

YES, THEY ARE. BUT ONCE IT DOES GET TO YOU, YOU'RE COLLECTING THAT 1% OR A LITTLE OVER 1% THAT DOES GET TO YOU.

YOU'RE ABLE TO COLLECT AROUND 51% OF IT ON AVERAGE.

BUT THEN WHAT ARE GOING TO BE THE CONSEQUENCES LATER IF WE'RE NOT ABLE TO RECOUP THAT? RIGHT? SO THIS IS A VERY CONSERVATIVE AMOUNT.

IT'S NOT GOING TO BREAK THE BANK, BUT BECAUSE OF THE PERCENTAGE, IF YOU DO THE PERCENTAGE OF WHAT OUR HOURLY EMPLOYEES ARE GETTING, THAT'S GOING TO BE A HUGE JUMP IN SOME OF OUR CATEGORIES.

THAT'S NOT GOING TO BE A HUGE JUMP IN OTHERS, OUR BUS DRIVERS START AT 22 NOW.

OKAY, WE'RE THE ONES THAT SET THE RATE AT 20.

WE SET THE TRENDS A LOT OF TIMES, BUT NOW THEY'RE NOT GOING TO FEEL IT.

BUT OUR CAFETERIA WORKERS ARE GOING TO FEEL IT.

OUR CUSTODIANS ARE GOING TO FEEL IT.

A LOT OF THESE OTHER PLACES ARE GOING TO FEEL IT.

AND THAT'S WHERE IT'S GOING TO COST US A LOT OF MONEY.

WE'LL BE IN THAT RANGE OF SHORT, BUT THAT GENERATES, IN YOUR ESTIMATION, THIS YEAR, THIS OPERATING YEAR, 18 TO $33 MILLION DEFICIT COMES OUT OF FUND BALANCE, WHICH STARTS GREATLY AFFECTING OUR ABILITY TO COME OUT OF FUND BALANCE IN THE FUTURE FOR BUSSES FOR ANYTHING BECAUSE WE'RE GOING TO I DON'T KNOW WHAT OUR CUSHION IS BETWEEN WHAT WE'RE REQUIRED TO KEEP IN RESERVE AND WHAT WE HAVE IN RESERVE.
